End-user licence agreement (EULA)

Publisher: ggaillet, self-employed, established in Tournai (Hainaut), Belgium,
contact@boothapp.be (the "Publisher").
Software: BoothApp (the "application"), including the installer, the updates and the documentation.
By installing or using BoothApp, you (the "User") accept this agreement.
BoothApp is built for professional use and asks for no company number to be installed or subscribed to. If you use it outside any professional activity, you are acting as a consumer and article 9 applies.
1. Licence
The Publisher grants a non-exclusive, non-transferable and revocable licence to use BoothApp to run one or more booths, according to the plan subscribed to and within the number of devices it includes.
2. Restrictions
The User shall not: (a) decompile, disassemble or reverse-engineer the application beyond what the law permits; (b) resell, rent or sub-licence the application without written agreement; (c) circumvent its protections, the kiosk lock or the licensing system.
3. Updates
The application may download and install updates from the official distribution channel. The Publisher does not guarantee support for outdated versions.
4. Data and privacy
BoothApp captures photographs of people and can share them (e-mail, QR, WhatsApp, printing, optional online gallery). The User (the operator) is the data controller under the GDPR for the photographs taken at their events, including those hosted in an online gallery: they inform the guests, collect their consent where required, and abide by the privacy policy. The Publisher acts as a processor for the hosting of the online gallery (see the terms of sale).
5. Intellectual property
BoothApp and its source code remain the property of the Publisher. Third-party libraries are governed by their own licences. The photographs produced belong to the User and/or to the people photographed, according to the applicable law.
6. No warranty / Limitation of liability
Towards a professional customer, the application is supplied "as is", with no warranty that it is free of errors or fit for a particular purpose, and the Publisher's liability is limited to the amount paid for the licence over the last 12 months. The Publisher is not liable for lost photographs, for hardware faults (camera, printer), or for the User's own GDPR failures.
Towards a consumer, these limitations do not apply: the legal guarantee of conformity for digital content and services, the right to the updates needed to maintain that conformity, and the remedies that go with them remain whole, and nothing in this agreement can reduce them.
7. Termination
The licence ends upon a breach of this agreement. On termination, the User stops all use and uninstalls the application.
8. Governing law
This agreement is governed by Belgian law. The courts of the judicial district of Hainaut (Tournai division) have jurisdiction over disputes with a professional customer; a consumer keeps the right to bring proceedings before the courts of their own domicile, and the choice of Belgian law does not deprive them of the mandatory rules of their country of residence.
9. Consumer protection
Where the User acts as a consumer, no provision of this agreement limits or excludes: the legal guarantee of conformity for digital content and services, the right to the updates needed to maintain that conformity, the legal remedies in case of a defect, the right of withdrawal on the terms set out in the terms of sale, or the price reductions and refunds imposed by law. Any clause to the contrary is deemed not written as regards that user.
