1. Purpose and scope
These terms govern the subscription to the BoothApp software offered by ggaillet, self-employed, established in Tournai, Belgium (see the legal notice) (the "Publisher") through boothapp.be. Any subscription implies full acceptance of these terms.
BoothApp is a production tool intended for professionals in the events and photography trade. No company number is required to subscribe, however: a business that is just starting is not yet registered, and waiting for a number before being able to test in real conditions would make no sense.
Consequently, where a customer subscribes outside any professional activity, they act as a consumer within the meaning of article I.1, 2° of the Belgian Code of Economic Law, and then enjoy the full set of rights the law reserves for them — right of withdrawal, legal guarantee of conformity for digital content and services, remedies, pre-contractual information. No clause of these terms may reduce those rights, and a clause that did so would be deemed not written.
2. Account and free trial
Use requires the creation of an account. A free 14-day trial is offered, with no bank card. At the end of the trial, access requires a paid subscription.
3. Plans and prices
Four plans are offered:

The Event Pass is temporary access without a subscription: it is credited to the account on purchase and must be activated from the customer area within 12 months of the purchase. The 72 hours start counting at activation, chosen by the customer — not at purchase.
Prices in euros. The amount shown is the total due: it is the amount charged. VAT not applicable, article 56bis of the Belgian VAT Code — the Publisher falls under the small-business exemption scheme and therefore charges no VAT. A VAT-registered customer consequently has no VAT to reclaim on these amounts.
Additional booths (Pro plan). Beyond the 2 booths included, each additional booth is added to the running Pro subscription as a separate line, at the same billing rhythm (monthly or yearly) and pro rata to the period already paid. The applicable price is shown in the customer area before any confirmation; no booth is ever charged without it. Removing a booth takes effect at the end of the current period.
4. Payment
Payments are handled by Stripe. The subscriptions (Pro and Local) renew automatically at each expiry date (monthly or yearly) at the rate then in force, until cancelled. The Event Pass is a one-off payment, with no renewal whatsoever.
Before each renewal of a yearly plan, a reminder is sent by e-mail at the latest 15 days before the deadline by which an objection must reach the Publisher, stating the expiry date, the amount that will be charged and how to object. The monthly plan, which can be cancelled at any time and ends at the close of the current month, is not subject to a monthly reminder. After a renewal, the customer may cancel at any time, free of charge and without indemnity, with a notice period never exceeding one month.
5. Right of withdrawal (consumers)
In accordance with Directive 2011/83/EU and the Belgian Code of Economic Law, a consumer has 14 days to withdraw from an online purchase, without giving a reason.
Subscriptions (Pro, Local). A subscription is a digital service supplied continuously: it is not "fully performed" on subscription, and the 14-day right of withdrawal therefore remains whole. A consumer who asked for the service to start immediately and then withdraws within the period pays only for the days actually used, pro rata; the balance is refunded within 14 days, by the same means of payment.
Event Pass. As long as it has not been activated, the consumer withdraws within 14 days and is refunded in full. The right of withdrawal only lapses at activation, and only where the consumer has beforehand, at the time of purchase, expressly requested immediate performance and acknowledged losing their right of withdrawal once the service is fully performed (article VI.53 of the Code of Economic Law). Both statements are collected through separate tick boxes at payment, and confirmed by e-mail; failing that, the right of withdrawal remains.
To withdraw, simply write to contact@boothapp.be before the end of the period — no particular wording is required. The free 14-day trial, with no bank card, also allows everything to be tested before paying anything at all.
6. Duration, cancellation and refunds
The Pro monthly plan carries no commitment: it can be cancelled at any time and then ends at the close of the current month. The yearly plans (Pro and Local) are paid in one instalment and can be cancelled at any time; they then end at the close of the current yearly period. In every case, cancellation is done from the application / customer area, without a refund of the pro rata already paid, save where a mandatory legal provision says otherwise.
The Event Pass expires automatically 72 hours after activation, with no cancellation needed. A pass not activated within 12 months of purchase is lost and gives rise to no refund, subject to the right of withdrawal described in article 5.
7. Availability and updates
BoothApp works offline. Updates are provided for the duration of the subscription or the pass. The Local plan includes no online service (apart from licence and account management). The Publisher does not guarantee uninterrupted availability of the online services (cloud sharing, licensing) that depend on third parties.
8. Liability
The software is supplied "as is". The Publisher's liability towards a professional customer is limited to the amount paid over the last 12 months, within the limits permitted by law. The operator alone remains responsible for GDPR compliance regarding the photographs taken at their events (see Privacy and Licence). Towards a consumer, the legal guarantees and remedies remain whole, as article 1 states.
9. Online gallery (option) — processor role
On the plans that include it (Event Pass, Pro), the customer may activate an online gallery for an event: the event's photographs are hosted temporarily so that guests can view and download them through a link / QR code, without creating an account. The customer (the photo booth operator) remains the sole data controller under the GDPR for those photographs; the Publisher acts as a processor (article 28 GDPR), strictly on the customer's instructions (activating the option, choosing the retention period). The photographs are hosted within the European Union (Supabase infrastructure) for the retention period chosen by the customer (7 to 90 days after the event, depending on the plan), then deleted automatically. The customer warrants that guests have been informed of the gallery's existence (see the Privacy policy) and remains responsible for how the access link is circulated. The total volume of photographs hosted per account is capped (quota stated in the plan subscribed to); beyond it, new photographs are refused until space is freed.
10. Governing law and disputes
These terms are governed by Belgian law. That choice does not deprive a consumer residing in another European Union country of the protection afforded by the mandatory provisions of their own country.
In the event of a dispute, an amicable solution is sought first: write to contact@boothapp.be. Failing agreement, a consumer may refer the matter free of charge to the Consumer Mediation Service (Boulevard du Roi Albert II 8 bte 1, 1000 Brussels).
The courts of the judicial district of Hainaut (Tournai division) have jurisdiction over disputes with a professional customer. A consumer may in every case bring proceedings before the court of their own domicile.
